A recent development in federal court may open the door once again for first-time DACA (Deferred Action for Childhood Arrivals) applicants — though with important restrictions that vary by location.
U.S. immigration officials are preparing to accept new DACA applications for the first time in years. However, due to ongoing legal challenges — particularly a court ruling out of Texas — the benefits available to new applicants will not be the same nationwide.
Here’s what you need to know:
If you live outside of Texas: You may be eligible to apply for DACA and receive full benefits, including protection from deportation and a work permit.
If you live in Texas: You may only be eligible for limited protection from deportation. Work authorization and lawful presence will not be granted under the current legal interpretation.
Current DACA recipients: You can continue to renew your DACA status and maintain your existing benefits, regardless of where you live.
It’s important to understand that this situation remains fluid. The DACA program continues to face legal challenges, and future rulings could change eligibility again. If you're considering applying for DACA or have questions about your current status, we strongly encourage you to consult with an experienced immigration attorney before taking action.
