OSHA can issue T and U visa certification

On February 13, 2023 the US Occupation Safety and Health Administration (OSHA) announced (OHA.gov) that they now have authority to issue u visa certifications to workers who have had their safety law violated as well as other workplace abuses such as wages stolen. The new rule takes effect March 30, 2023.


Prior to this announcement only law enforcement agencies, prosecutors, or judges involved in a criminal investigation could certify a U or T visa.


The new rules will protect workers from immigration related retaliation from employers and will allow works to remain in the USA in lawful status while OSHA investigates and prosecutes illegal workplace practices.


The U and T visas grant workers temporary immigration benefits with a pathway to permanent residency for them and their families.
