Public Charge injunction removed

In update to our previous blog, on September 11, 2020 the Second Circuit Court granted the government’s motion to lift the lower court’s July 29, 2020 injunction nationwide. This allows the new public charge rule to be in effect and USCIS is now free to require the I-944 Form in all jurisdictions.


The injunction blocking the Department of State from applying the new public charge rule at consulate and embassies abroad is still in effect.
